1. ACKNOWLEDGMENT OF RISK
I understand that entering or using Smash Courts involves inherent risks, including but not limited to slips, falls, collisions, being struck by balls or equipment, and risks related to active play.
These risks apply to all areas, including:
Courts and play areas
Common areas and washrooms
Entrances, exits, and walkways
Parking lot and exterior areas
2. ASSUMPTION OF RISK
I voluntarily assume all risks associated with entering or using Smash Courts, whether participating, observing, or accompanying others.
This Waiver applies to myself and any guests I bring.
3. RELEASE OF LIABILITY
In consideration of being permitted to enter or use Smash Courts, I release and hold harmless:
Smash Courts, its owners, operators, employees, contractors, volunteers, agents, AND the property owner/landlord
from any and all claims, damages, injuries, losses, or causes of action, including those arising from negligence, occurring on the premises.
4. GUEST RESPONSIBILITY
I accept full responsibility for the conduct and safety of any guests or individuals I bring, including during after-hours access.
5. AFTER-HOURS & UNSUPERVISED USE
I understand that after-hours access is unsupervised, and no staff are present.
I agree that:
❌No playing under the influence of alcohol, drugs, or cannabis; or bringing it on the premises
❌ No solo use after hours – I will not enter or remain alone
✅ Participants should arrive and leave together, including the parking lot
✅ I am responsible for contacting 911 in an emergency
Failure to follow these rules may result in loss of access privileges.
6. COMPLIANCE WITH RULES
I agree to follow all posted rules, signage, and facility policies and code of conduct.
Failure to comply may result in removal or suspension of access.
7. INDEMNIFICATION
I agree to indemnify and hold harmless Smash Courts and the property owner/landlord from any claims or legal costs arising from my actions or the actions of my guests.
8. PHOTOGRAPHY, VIDEO & MEDIA CONSENT
I acknowledge that photographs, video recordings, and other media may be captured while I am on the premises of Smash Courts, including during leagues, programs, camps, tournaments, open play, and special events.
I consent to the use of my image, likeness, voice, and appearance in such media for lawful promotional, marketing, educational, or informational purposes by Smash Courts, including use on websites, social media, digital or print advertising, and other communications.
I understand that such media remains the property of Smash Courts and that I waive any right to inspect or approve the finished product or its use.
I acknowledge that no compensation or remuneration will be provided for the use of such media.
If I do not wish to be photographed or recorded, I understand that it is my responsibility to notify Smash Courts staff in writing prior to participation.
PERSONAL PROPERTY
I understand Smash Courts is not responsible for lost, stolen, or damaged personal belongings, including but not limited to:
Clothing
Cell phones
Electronics
Sports equipment
Jewelry
Backpacks
Money
MEDICAL AUTHORIZATION
In the event of illness or injury, I authorize Smash Courts staff to:
Administer reasonable first aid
Contact Emergency Medical Services (911)
Arrange transportation for emergency medical treatment
Contact the emergency contact listed above
I understand I am responsible for all medical expenses incurred.
