IMPORTANT – READ CAREFULLY BEFORE SIGNING
By signing this Agreement, you are giving up certain legal rights, including the right to sue. This Agreement applies to participation in the Smash Courts Summer Camp and all related activities.
ACKNOWLEDGEMENT OF RISK
I understand and acknowledge that participation in Smash Courts Summer Camp involves inherent risks that cannot be eliminated regardless of the care taken by Smash Courts.
These risks include, but are not limited to:
Playing pickleball and other sports
Indoor and outdoor recreational games
Slips, trips, and falls
Collisions with participants, staff, equipment, paddles, balls, nets, or obstacles
Heat, dehydration, sun exposure, weather, insects, and environmental conditions
Playground equipment and outdoor recreation
Uneven ground, sidewalks, curbs, and parking lots
Physical exertion
Exposure to communicable illnesses
Acts or omissions of other participants
Transportation on foot during supervised activities
Emergency situations requiring evacuation or relocation
I understand that serious injury, illness, permanent disability, property damage, or death may occur.
ASSUMPTION OF RISK
I certify that my child is physically able to participate in camp activities.
I voluntarily assume all risks associated with my child's participation in the Smash Courts Summer Camp.
I understand that participation is voluntary and my child may stop participating at any time if requested by staff for safety reasons.
RELEASE OF LIABILITY
In consideration of my child being permitted to participate, I release, waive and forever discharge:
Smash Courts, its owners, directors, officers, employees, instructors, volunteers, contractors, agents, sponsors, affiliates, successors, assigns, and the property owner/landlord
from any and all liability, claims, demands, actions, causes of action, damages, losses, expenses, legal costs, or compensation arising from participation in camp activities, including those arising from negligence, except where prohibited by law.
This release includes injuries, illness, death, property damage, theft, or loss occurring on or off the Smash Courts premises during authorized camp activities.
MEDICAL AUTHORIZATION
In the event of illness or injury, I authorize Smash Courts staff to:
Administer reasonable first aid
Contact Emergency Medical Services (911)
Arrange transportation for emergency medical treatment
Contact the emergency contact listed above
I understand I am responsible for all medical expenses incurred.
CAMP RULES & EXPECTATIONS: I understand my child must:
Respect staff, volunteers, and other campers
Follow all camp rules and instructions
Use appropriate language
Treat equipment and facilities with respect
Wear appropriate athletic clothing and non-marking indoor shoes
Remain with their assigned group
Participate safely
Smash Courts reserves the right to remove any camper whose behaviour jeopardizes the safety or enjoyment of others. No refund will be provided for dismissal due to misconduct.
PERSONAL PROPERTY
I understand Smash Courts is not responsible for lost, stolen, or damaged personal belongings, including but not limited to:
Clothing
Cell phones
Electronics
Sports equipment
Jewelry
Backpacks
Money
INDEMNIFICATION
I agree to indemnify and hold harmless Smash Courts, its owners, employees, volunteers, contractors, agents, affiliates, and the property owner/landlord from any claims, damages, losses, liabilities, or legal expenses arising from my child's participation in camp or from the actions of my child.
ELECTRONIC SIGNATURE & GOVERNING LAW
I agree that this Agreement may be signed electronically or in writing and that either form of signature shall be legally binding.
This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario.
